Dumpster Rental Terms & Conditions

Pricing & Payment

The customer agrees to pay Heartland Dumpster Rental a base fee to rent a roll-off dumpster.

The customer should understand that the base fee includes (1) delivery to a specified address, specified rental period, (1) dumpster pick-up, and 1-3 tons in disposal fees.

The customer agrees to pay a variable rate per ton for all disposal charges exceeding the specified weight limit.

The customer agrees to pay for any special item disposal surcharges incurred including; but not limited to mattresses, box springs, tires, televisions, propane tanks, appliances, and electronics.

The customer should understand that Heartland Recycling Services is a transportation company only and not affiliated with any 3rd party landfills or transfer stations. As such, the customer will not hold our company financially responsible or blame-worthy for any extra fees incurred at these disposal facilities.

The customer agrees to pay for each additional day they request to keep the dumpster.

The customer will not hold Heartland Recycling Services financially responsible or blame-worthy for weight overages incurred due to rain, water, snow, or ice that has accumulated in the dumpster. The customer may cover the dumpster with a tarp to prevent water weight overages.

The customer is not allowed to fill any dumpster higher than the top of its sides. If the driver rejects the load at pick-up due to overloading the customer must unload the dumpster will be responsible for paying a “dry run” fee plus any fuel surcharges incurred.

The customer accepts all responsibility for making payment and property accessible to the driver. If the driver cannot deliver or pick-up your dumpster due to non-payment, unsigned-contract, low-hanging tree branches, low laying power lines, locked gates, parked cars, wet grass, or any other financial or physical obstruction, there will be a “dry run” fee incurred plus any fuel surcharges.

Customer agrees to pay a cancellation fee if delivery is not canceled within 48 hours.

Customer agrees to pay any fuel surcharges specified by Heartland Recycling Services.

Customer should understand that payment for all base fees as well as any known additional rental time will be due upon delivery of the container. Any additional fees due to overages or other fees not paid for upon delivery are due within 7 days of container being picked up.

The customer should understand and accept that 33% of any unpaid balance will be added to my bill as a late fee starting 7 days after the dumpster is picked up. If this balance is not paid, there will be a late fee of 15% for every month it remains unpaid. There will be a minimum of a $50.00 late fee for any unpaid balance.

The customer agrees to pay all costs and expenses for the collection of unpaid amounts including without limitation, attorney fees, 3rd party collection fees, court costs, and other costs allowed by the law.

The customer authorizes Heartland Recycling Services to have unrestricted access to charge any unpaid balance to the customer’s account at any time.

Use of Dumpsters

While roll-off dumpsters are in your possession, you will not place or allow to be placed into the container:

  • substances hazardous to health such as toxic or corrosive materials or liquids
  • any liquids of any kind whether contained or not
  • cans, drums, tanks, or other containers of any kind unless they are empty and crushed; so incapable of carrying any liquid
  • medical waste or animal carcasses of any kind or quantity
  • any other material not listed above however considered unsuitable for containment e.g. malodorous waste; including but not limited to: asbestos, paint, tires, gas bottles, liquids, and solvents
  • extremely heavy materials such as brick, asphalt, slate, gravel, dirt, rock, sand, or concrete. Please let us know and we will help you dispose of such heavy items in a more efficient manner
  • any material that could cause a fire inside the dumpster

The customer is not allowed to fill any dumpster higher than the top of its sides and in such a manner as to prevent spillage of material from the refuse dumpster either while stationary or in transit. Customer should not rely on our tarp system to contain materials while in transit.

Any overweight citations or legal judgments against Heartland Recycling Services while hauling from the Customer’s property or job site will be paid by customer.

The customer is not allowed to move and/or allow to be moved the dumpster after it is placed. Customer may request relocation for a fee plus any fuel surcharges incurred. If the dumpster is found to be moved without the consent of Heartland Recycling Services, the customer will be charged a penalty fee.

The customer accepts full responsibility for the contents of the dumpster and accepts risk for illegal/illicit dumping

The customer accepts responsibility for any permits that may be required prior to dumpster delivery. Any dumpster that cannot be delivered due to a permit issue will result in a “dry run” fee plus and fuel surcharges charged to the customer

The customer understands that our dumpsters are not water-tight and accepts responsibility for any spillage of unacceptable liquids

The customer understands the rental time for the dumpster and that at any time after the rental period has expired, Heartland Dumpster Rental may remove the dumpster from the property

The customer may request dumpster deliveries to yards and other areas with soft ground. However, if this request causes our equipment to get stuck, the customer is responsible to pay all expenses involved in retrieving trucks or dumpsters

Damage to equipment

The customer is responsible for any damages to our dumpsters beyond minor paint scratches. Any dings, dents, or holes found will be fixed at the customers expense.

Waiver of Liability

Customers are cautioned that roll-off trucks and equipment can be heavy and bulky. Any conditions susceptible to damage (e.g. roads, culverts, fences, mailboxes, guttering, basketball goals, landscaping, driveways, curbs, lawn, sprinkler systems, shrubbery, etc.) by delivery, placement or dumping of a container must be disclosed to Heartland Dumpster Rental in writing before the time of delivery. The customer waives all claims for property damage or other loss, injury, death, or claim against Heartland Dumpster Rental arising out of the delivery, removal, or use of said container. The customer similarly agrees to indemnify and hold harmless Heartland Dumpster Rental against all loss or liability from risks or claims arising from container location or placement.

Access and Ground Conditions

The customer will be responsible for the provision of free and suitable access to and from the delivery site (including the removal and reinstatement of local obstructions) and for ensuring suitable ground conditions for the delivery, placement, and removal of the dumpster. No responsibility will be accepted for the damage to any surface and you should therefore take steps to protect surfaces (e.g. paving slabs, soft ground) before delivery.

Should the container cause damage to the concrete or asphalt during loading or unloading, Heartland Dumpster Rental will not accept financial responsibility for said damage. We have specifically identified that containers may cause damage and that the placement of these containers is the property owner or site manager’s responsibility in determining a sites exposure to this type of damage.

Should the customer fail to return the container, Heartland Recycling Services maintains the right to enter upon the premises where the container may be, without notice, and take possession of and remove it at the Customer’s expense, all without legal process, the customer hereby waving any claims for damage, injury, or death from any such entry, taking, or removal.

Guarantee of Payment

In the event of a voluntary or involuntary petition for bankruptcy or receivership filed by or against the Customer, the rental agreement shall be terminated on the filing date, and the equipment shall be returned to Heartland Recycling Services, and all unpaid rents shall be paid by the undersigned. The customer’s signature on this rental agreement will constitute both their corporate and personal guarantee to Heartland Recycling Services that it’s invoices will be paid in full, including any overages or penalties incurred.
